Nye County Commissioners revoked a conditional use permit for a Pahrump adult day care facility based on the affirmation that the owner has not complied with conditions of approval and has numerous violations at the facility.
Several life safety inspections, conducted by Pahrump Valley Fire-Rescue and a courtesy inspection conducted by the Pahrump Building and Safety Department revealed numerous violations under fire, building, plumbing and electrical codes at Rancho View Estates, an adult day care facility located at 4540 S. Money St. in Pahrump, according to the information provided to Nye County Commissioners by the Planning Department.
Gertrude Schwartz, the property owner, had voluntarily surrendered the business license to the town of Pahrump on June 10, 2015. It was found that the property violated the conditions of approval of a conditional use permit, said Nye County Planner Beth Lee.
During Wednesday’s meeting, County Planner Beth Lee said violations warranted revocation of the conditional use permit.
“This, combined with the property owner’s failure to comply with the conditions of approval associated with the conditions of use permit and numerous code violations and life safety violations, staff for finding supporting evidence to determine the conditions of approval have been violated and therefore staff has recommended that condition of the use permit for adult day care facility to be revoked.”
Schwartz failed to comply with seven out of nine special conditions of approval associated with the approved conditional use permit that was granted on Jan.16, 2013, according to the document presented to the countyâs commissioners on Wednesday.
Some of the violations included change of occupancy without proper permits; structural, electrical and plumbing construction without permits; improper emergency exit signage, emergency lighting failure; expired portable fire extinguishers; inoperable fire suppression system.
“During several conversations with the property owner, she stated thereâs no longer interest on her part with moving forward with developing this property as an adult day care facility,” she said.
Schwartz didnât appear at the Wednesday meeting and couldnât be reached for comment Thursday.
“We have previous database that we used as when the planning department started it tracks all the of the applications that have been approved and the current system also tracks approvals, expiration dates, all relevant information, and it can be exported into a report,” Lee said.
