Plaintiff, Kathleen Bensel (“Plaintiff”), in her capacity as remainder beneficiary of the Howard R. Bensel, Jr. Irrevocable Trust f/b/o Anna Mae Bensel (the “Trust”), created by the Howard R. Bensel, Jr. Irrevocable Trust Agreement, dated July 18, 1995, has filed a complaint in this matter for appointment of a successor trustee of the Trust pursuant to the terms of the Trust Agreement to administer the Trust and make necessary distributions of income and principal to its beneficiaries, or, alternatively, to modify the Trust to permit the appointment of the trustee selected by a majority of the beneficiaries. The proposed successor trustee is Walter J. Lynch. The previous trustee of the Trust, Anna Mae Bensel, has passed away without appointing a successor trustee.
