Man receives maximum sentence for assaulting granddaughters

The man charged with sexually assaulting his own granddaughters on several occasions, received the stiffest sentence Fifth District Court Judge Robert Lane could hand down on June 8.

Dennis Roy Garcia was charged with committing three separate crimes involving five children following his first arrest nearly 10 years ago.

Nye County Chief Deputy District Attorney Kirk Vitto said Garcia will spend decades in prison for his crimes.

“Judge Lane sentenced Mr. Garcia to an aggregate 16-to-40 years in prison with two consecutive terms of 364 days in jail, should he ever be paroled from the Nevada Department of Corrections,” he said.

On April 6 of this year, Garcia pleaded guilty to one count of attempted incest, a category “B” felony, as well as attempted sexual assault of a child less than 14 years of age, open and gross lewdness and one count of preventing or dissuading a person from testifying or producing evidence.

Garcia, according to court documents, sexually assaulted his 16-year-old granddaughter between January and May of 2006.

The assault resulted in the granddaughter’s birth of Garcia’s child.

He was also charged with open and gross lewdness on an unidentified female between the spring and summer of 2008.

Vitto said some of Garcia’s previous offenses, included “having his hands down the pants” of a 3-year-old and a 14-year-old.

Vitto said Garcia’s first trial in 2009, resulted in a mistrial/hung jury, while at the second he was found guilty.

“After serving roughly four years in prison his attorney successfully moved for a new trial,” Vitto said. “The case was ultimately resolved by way of a guilty plea.”

During this month’s sentencing hearing, Vitto said Garcia had no redeeming values.

“He has raped and molested multiple children,” he said. “He’s a drug addict, a thief and from a worldly perspective, without redeeming social value. He is a rogue’s gallery all by himself.”

Garcia will also reimburse Nye County $1,000 for services rendered in his defense.
